1. Introduction

Welcome to Maintenix, operated by Apploom Technologies LLC (“we”, “us”, “our”).

These Terms & Conditions (“Terms”) govern your use of the Maintenix web portal and mobile applications (together, the “Service”). By accessing or using Maintenix, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Maintenix is designed primarily for property developers, building owners, property management companies and their authorised supervisors, technicians and tenants.

2. Accounts and access

A. Registration and roles

To use certain features of the Service you may need an account created by you or by your organisation (for example a developer or property manager). You must provide accurate and complete information and keep it up to date.

Different roles (such as tenant, technician, supervisor or admin) may have different permissions and access levels within the Service.

B. Account security

You are responsible for maintaining the confidentiality of your login details and for all activities that occur under your account. You must notify us or your organisation immediately if you suspect any unauthorised access.

C. Suspension and termination

We may suspend or terminate your access to the Service if:

  • You breach these Terms or applicable laws

  • You misuse the platform or compromise its security

  • Your organisation’s subscription or agreement with us ends

Your organisation may also manage or terminate access for users under its account.

3. Use of the Service

We grant you a limited, non-exclusive, non-transferable and revocable licence to use Maintenix in accordance with these Terms and any agreements between Apploom Technologies LLC and your organisation.

You agree not to:

  • Use the Service for any unlawful, fraudulent or harmful purpose

  • Attempt to gain unauthorised access to any account, system or data

  • Copy, modify, reverse-engineer, decompile or disassemble any part of the Service

  • Bypass or interfere with security or access control features

  • Use automated tools to scrape or extract data, except through approved APIs and with written permission

We may change or discontinue parts of the Service at any time, with or without notice, provided this is consistent with our contractual commitments.

4. Maintenance requests and user content

A. User Content

You may submit information, text, photos, documents and other materials through the Service, including maintenance requests, notes, comments and chat messages (“User Content”).

You remain responsible for your User Content and must ensure that it:

  • Is accurate and relevant to the building or unit

  • Does not infringe any third-party rights (including privacy, copyright or trademarks)

  • Does not contain unlawful, abusive, offensive or inappropriate material

B. Licence to use User Content

You grant Apploom Technologies LLC a worldwide, non-exclusive, royalty-free licence to use, store, process, display and reproduce your User Content solely for the purposes of operating, supporting and improving the Service.

For white-label deployments, your organisation (for example, a developer or property manager) may also be considered the controller of data you submit to Maintenix and may set additional rules.

5. Intellectual property

All rights, title and interest in and to Maintenix, including the software, design, logos, text, graphics and documentation, are owned by Apploom Technologies LLC or its licensors.

Except for the limited licence granted in these Terms, you are not granted any rights to our intellectual property. You may not use our names, logos or trademarks without our prior written permission, other than as necessary to identify yourself as a user of the Service.

6. Fees and subscriptions

Details of pricing, billing and subscription plans are provided separately in our commercial agreements or on our website.

Developers and property owners may choose between Maintenix-branded subscriptions and white-label (branded) deployments.

Tenants and technicians usually access the Service through their building or employer and do not pay Apploom Technologies LLC directly.

Failure to pay applicable fees may result in suspension or termination of access for the relevant organisation and its users.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use and protect personal information. By using Maintenix, you consent to our data practices as described in the Privacy Policy.

8. Disclaimer and limitation of liability

The Service is provided “as is” and “as available” without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or availability.

To the maximum extent permitted by law:

  • Apploom Technologies LLC is not liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of profits, data, goodwill or business interruption arising out of or relating to your use of the Service.

  • Our total aggregate liability arising out of or relating to the Service is limited to the amount actually paid to us for the Service by your organisation in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.

9. Indemnity

You agree to indemnify, defend and hold harmless Apploom Technologies LLC, its directors, employees, contractors and agents from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to:

  • Your use or misuse of the Service

  • Your breach of these Terms

  • Your User Content or any violation of the rights of others

10. Changes to these Terms

We may update or modify these Terms from time to time. When we do, we will update the Effective Date at the top and, where appropriate, provide additional notice through the Service or by email.

Your continued use of Maintenix after the updated Terms take effect constitutes your acceptance of the new Terms.

11. Governing law

These Terms are governed by and construed in accordance with the laws of Dubai, United Arab Emirates, without regard to its conflict of law principles.

Any disputes arising out of or in connection with these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.
